Terms of Service

1. Service Description:

The Photographer agrees to conduct a photography session for the Client according to the agreed-upon details, including location, date, and time.

 The photography services provided include photo sessions for various occasions such as weddings, engagements, family sessions, and individual portraits.


2. Payments:

 

The Client agrees to pay the total agreed-upon fee for the photography services. A 50% deposit will be required to secure the booking, and the remaining balance is due before the delivery of the final photographs.

  In case of cancellation by the client, the initial payment is non-refundable.


3. Intellectual Property:

 

The Photographer retains the copyright to all images taken during the session. The Client receives a non-exclusive license to use the images for personal and non-commercial purposes. In the case of requiring commercial use and/or rights release, the Client must inform the Photographer to reach a suitable agreement for both parties.


4. Use of Images:

 

The company acknowledges the privacy of all materials taken during the session. Permission may be requested to use the images for promotional purposes, including social media and the website, unless otherwise agreed upon in writing.

 The client receives a non-exclusive license to use the images for personal and non-commercial purposes.


5. Cancellation:

 

In the event of cancellation by the Client, the deposit will not be refundable. If the Photographer cancels, any payments made by the Client will be refunded.

If the client is more than 15 minutes late without prior notice, the session may be canceled, and no refund will be issued.


6. Image Delivery:

 

The Photographer will deliver edited digital images within the agreed-upon timeframe after the session.

 

7. Inclement Weather:

 

If the Photographer is not on location and weather conditions prevent the session from taking place on the agreed-upon date and time, a new date will be arranged in consultation with the Client and the Photographer. If rescheduling is not possible, the deposit will be fully refunded. If the Photographer is on location and weather conditions do not improve within a 30-minute window, a new date will be rescheduled between the parties. If rescheduling is not possible, the deposit will be refunded, deducting the proportional transportation cost of the equipment.

 

8. Liability:

 

The Photographer is not liable for any injuries or damages during the session. The Client is responsible for their own safety and that of any other individuals present.


9. Photo Editing Policy:


Editing Scope: Our editing services are limited to basic adjustments, such as skin retouching and color correction. We do not add elements to photos, alter body shapes, change skin tones, or modify clothing.

Advanced Editing: We offer more complex edits for a limited number of photos at an additional cost. Please contact us for a personalized quote if you require advanced editing services.


10. Photo Quality Considerations:


Representation of Reality: Photography captures the reality of the moment. Weather conditions such as cloudy skies, rain, or wind can affect the quality of the photos. If wind is forecasted, we recommend choosing an appropriate hairstyle, especially for individuals with long hair, to avoid issues.


Environmental Factors: Factors such as atmospheric pollution can reduce the sharpness and contrast of photographs. Additionally, the time of day and the position of the sun may affect lighting and shadows in the images.


Client Preparation: We recommend clients consider these factors when planning a photoshoot and be prepared for the conditions present at the time of the session.


11. Family Sessions Policy:


Working with Children: We treat children with patience and care during photoshoots. However, the care and behavior of the children are the full responsibility of their parents or guardians during the session.


Adult Responsibilities: To ensure an enjoyable and productive experience, we encourage adults to assist and supervise the children throughout the session.


Clothing and Coordination: We recommend families coordinate their outfits in advance, avoiding overly bold patterns or colors that might distract from the main focus of the photograph.


12.Delivery Times:


Standard Delivery Time: Our standard delivery time is 15 business days after the client selects their photos.


Delayed Selection: If the client takes more than two weeks to select their photos, the delivery time may be extended depending on our workload at that time.
